Terms and Conditions

These Terms and Conditions ("Terms") are a binding agreement between you and Plainsmen Outdoors, LLC, d/b/a Trophy Scan, a Texas limited liability company ("Trophy Scan," "we," or "us"). They cover your use of the Trophy Scan mobile application (listed in the App Store as “Trophy Scan Mobile”) (the “App”), the www.trophyscan.com website (the “Website”), and the services offered under any of the foregoing (together with the App and Website, the "Services").

PLEASE READ THESE TERMS CAREFULLY, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND TROPHY SCAN. By using the Services, including but not limited to by creating an account, downloading the App, or accessing the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

IMPORTANT: Section 12 of these Terms contains a binding arbitration provision and a class action waiver that affect your legal rights. Please read it carefully.

Summary: This summary is provided for convenience only; the Terms below govern.

Scanning and Field Scores are currently provided at no charge. Certified Scoring and contest entry may require payment, and Certified Scoring may be offered at no charge for a limited period.
You retain ownership of your User Content and grant us a broad license to host, adapt, publish, display, and promote it for the Services (see Section 4.1). Content posted to the public feed is public. Completed scans are posted to the feed by default, and automatic posting may be disabled in the App.
Only lawful harvests may be posted. Poaching content, misrepresented trophies, and harassment are prohibited.
Disputes are resolved by individual arbitration where local law permits, subject to a 30-day opt-out.

1. Access to Services

1.1 Eligibility and Accounts

You must be at least 13 years old to create an account or use the Services. If you are under 18, you may use the Services only with the consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Services.
The Services are only intended for use by individuals residing in and located in the U.S.A. If you are outside the U.S.A., you are not permitted to use the Services.
You agree to provide accurate registration information, keep your credentials secure, and notify us of any unauthorized use. You are responsible for all activity on your account.
One account per person. Accounts may not be sold, transferred, or shared.
Use of the Services is intended for personal use only, with the exception of limited commercial use for internal business purposes only if you are an outfitter, ranch, or taxidermist. If you believe you fall into this exception, you must contact us prior to using the Services and receive our written consent to use the Services for the contemplated business purposes, which we may give or deny in our sole discretion. You are prohibited from using the Services for any commercial use or purpose unless we expressly agree in writing otherwise.

1.2 Prohibited Uses

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use any part of them:

In any way that violates any applicable federal, state, or local law or regulation.
For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the content standards set out in these Terms or the Privacy Policy.
To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
To impersonate or attempt to impersonate Trophy Scan, a Trophy Scan employee, another user, or any other person or entity (including, without limitation, by using email addresses or usernames associated with any of the foregoing).
To collect or track the personal information of third parties without authorization.

Additionally, you agree not to:

Use the App or Website in any manner that could disable, overburden, damage, or impair the App or Website or interfere with any other party’s use of the Services.
Use any robot, spider, or other automatic device, process, or means to access the App or Website for any purpose, including monitoring or copying any content.
Use any manual process to monitor or copy any of the material on or comprising the App or Website, or for any other purpose not expressly authorized in these Terms, without our prior written consent.
Use any device or software that interferes with the proper working of the Services.
Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App or Website or the server or databases on which either is stored or connected.
Attack the App or Website via a denial-of-service attack or a distributed denial-of-service attack.
Otherwise attempt to interfere with the proper working of the Services.

2. The Services

The Services enable you to scan a non-moving animal or mount with a supported mobile phone, generate a 3D model, obtain a score from our proprietary scoring technology, store scans in the cloud, share them with the Trophy Scan community, and comment on posts by others in the Trophy Scan community.

2.1 Field Scores and Certified Scores

Field Scores (as shown in the App) are automated estimates provided at no charge for personal and social use and displayed as a range. They are not official records, and we do not guarantee their accuracy.
Certified Scoring (as shown in the App) gives you an official Trophy Scan certified score, following the scoring standard identified at purchase. Certified Scoring is ordinarily a paid feature. We may offer it at no charge or at a discount for a limited period, or through promotional codes or certification tokens. Certification does not constitute entry into, or acceptance by, any third-party record book (for example, Safari Club International, Boone & Crockett, or Pope & Young); those organizations set their own requirements and Trophy Scan does not control such organizations.

2.2 Accuracy Disclaimer

Scores depend on scan quality, capture conditions, and device capability, and are provided "as is." Trophy Scan makes no representations or warranties of accuracy of any scan and is not liable for decisions made in reliance on a score, including the purchase or sale of animals, taxidermy work, or contest outcomes.

2.3 Cloud Storage

We provide cloud storage for your scans. "Unlimited" storage is subject to fair use, and we may impose reasonable limits to prevent abuse. We are not liable for lost or corrupt data, and you are responsible for exporting your scans where that feature is available.

2.4 Changes to the Services

We may add, change, or remove features, or discontinue the Services, at any time, with or without notice. If we decide in our reasonable discretion that we have discontinued a paid feature before you have received what you paid for, we will issue a prorated refund on a case-by-case basis.

2.5 Trophy Transfers

Where available, you may transfer a trophy you own to another person, whether or not they already hold a Trophy Scan account (for example, the hunter who made the harvest) by entering that user's email address. When you transfer a trophy: (a) if the recipient is already a Trophy Scan user, we show you the recipient's display name when you look them up, so that you can confirm you have the right person, and the recipient sees your display name; (b) if the recipient is not yet a Trophy Scan user, we send an invitation to the email address you enter, on your behalf; (c) once the recipient accepts, the transfer cannot be reversed, and the trophy, including its scan, score, and any certification, becomes the recipient's; and (d) if the trophy has a post on the community feed, that post is removed when the transfer completes, along with the comments and likes on it. Transfer of a trophy does not transfer your account or any purchase.

3. Fees and Payments

Scanning and Field Scores are currently provided at no charge. We may provide additional paid services in the future and reserve the right to charge a fee for any feature offered under the Services, including add-on features or subscriptions.
Payments are processed by third-party payment processors, including Apple and Google as applicable. We do not store full payment card details.
Except as required by law or as otherwise stated in these Terms, all fees are non-refundable.
We may change pricing at any time. Changes apply prospectively only and do not affect purchases already made.
Promotional codes, coupon codes, and certification tokens have no cash value, may not be sold or transferred, may expire or be limited to specific features, and may be revoked if obtained or used fraudulently.
If we offer subscriptions, they renew automatically until cancelled. You may cancel at any time in the App or through your App Store or Google Play account settings, effective at the end of the current billing period. We will give at least 30 days' notice before any subscription price increase takes effect.

4. User Content and the Social Feed

The Services include social features, including a public feed, profiles, follows, comments, and shareable photos, videos, and GIFs ("Social Features"). Content you provide or post, including scans, 3D models, GIFs, photos, videos, scores, captions, profile information, and comments ("User Content"), remains yours, subject to the licenses set forth in this Section 4. You are responsible for all User Content you upload and all User Content must comply with these Terms, the Community Rules, and our policies, including the Privacy Policy. Your User Content must not be harassing, obscene, infringing on another’s rights, or otherwise in violation of our Terms or policies and we reserve the right to remove any such User Content and/or suspend or deactivate your account in our sole reasonable discretion (see Section 4.4).

4.1 License You Grant Us

By posting User Content, you grant Trophy Scan a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt (for example, to generate GIFs, thumbnails, and 3D renderings), publish, display, and distribute it, in part or in whole, to operate, improve, and promote the Services. This license ends when you delete the content or your account, except for (a) content others have shared or re-posted, (b) backup copies we retain for a commercially reasonable period, and (c) comments retained in de-identified form (shown as "Anonymous") to preserve the coherence of other users' conversations.

4.2 Public Visibility

Content posted to the public feed is public. Others may view, share, and re-share it on and off the platform. By default, a completed scan is shared to the public feed as a post. You may disable automatic posting in the App (Privacy & Sharing settings, Auto-post finished scans) and delete any post. Trophies that are not posted remain in your private storage. Do not post content you wish to keep private. By using the public features of the Services, you consent to share your content publicly.

4.3 Community Rules

The Community Rules shown in the App, which you accept when you sign up, are part of these Terms. Where they are stricter than this Section (for example, on animal cruelty or fair chase), they control. You agree not to post or transmit content that:

Depicts, promotes, or results from illegal hunting or fishing, including poaching, taking game out of season or without a valid license or tag, or violating fair-chase or trespass laws.
Misrepresents a harvest, including false claims about species, location, date, legality, or the identity of the person who made the harvest, or scans of animals you did not lawfully harvest or own.
Harasses, threatens, demeans, or bullies any person, including anti-hunting harassment directed at other users.
Is unlawful, defamatory, obscene, pornographic, hateful, infringes any third party's intellectual property, privacy, or publicity rights, or in any way violates applicable federal, state, or local law or regulation.
Is spam, deceptive commercial solicitation, or impersonates any person or entity.
Contains malware, scrapes the Services, or attempts to manipulate scores or leaderboards (including bot activity).
Is otherwise against our Terms and/or policies.

4.4 Moderation and Enforcement

We may, but are not obligated to, monitor, remove, or restrict any User Content. We may also suspend or terminate accounts, remove contest entries, and withhold prizes for violations. We may report suspected illegal harvest activity to wildlife authorities, and we will cooperate with law enforcement as required by law. We are not responsible for User Content or for any failure to remove it.

If you believe content on the Services is unlawful or violates these Terms, you may report it using the “Report” action in the App on any post, comment, or profile, or by email to support@trophyscan.com. You may also block another member in the App, which hides their posts and comments from you. We review every report and act on an individual report in our reasonable discretion.

4.5 Feedback

If you submit ideas or suggestions to us, we may use them without restriction and without compensation.

5. Intellectual Property

The Services, including the App, Website, our proprietary scanning and scoring technology, as well as the designs, logos, text, images, audio, video, trademarks, slogans, and code used for or with the same, are owned by Trophy Scan or its licensors and protected by copyright, trademark, patent and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial use (or internal business use if you are an outfitter, ranch, or taxidermist), consistent with these Terms. You may not copy, modify, reverse engineer, scrape, resell, or create derivative works from any of the Services except to the extent the law permits. We reserve all rights not granted here.

6. Copyright Complaints (DMCA)

If you believe content on the Services infringes your copyright, send a notice that complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512 to our designated agents: Craig Harrison and Ean Patry, Plainsmen Outdoors, LLC dba Trophy Scan, 15395 TX-29, Buchanan Dam, TX 78609, support@trophyscan.com.

7. Third-Party Services and Links

The Services may link to or integrate third-party services such as payment processors, social networks, record books, and third-party websites. We are not responsible for those services, their content, or their practices, and your use of them is governed by their own terms. Intellectual property on third-party services belongs to the respective owners.

8. Disclaimers

THE SERVICES, INCLUDING ALL SCORES, SCANS, CONTENT, THE APP, WEBSITE, AND CONTESTS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. NEITHER TROPHY SCAN NOR ANY PERSON ASSOCIATED WITH TROPHY SCAN MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.

TROPHY SCAN IS DESIGNED TO BE USED IN CONNECTION WITH HUNTING, WHICH IS AN INHERENTLY DANGEROUS ACTIVITY. THE SERVICES PROVIDE NO SAFETY GUIDANCE, AND YOU ARE SOLELY RESPONSIBLE FOR SAFE AND LAWFUL HUNTING PRACTICES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THESE MAY NOT APPLY TO YOU. YOU EXPRESSLY UNDERSTAND AND AGREE THAT TO THE FULLEST EXTENT OF LAW, YOUR USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK. CHANGES ARE PERIODICALLY MADE TO THE SERVICES AND MAY BE MADE AT ANY TIME WITHOUT NOTICE TO YOU. IF YOU ARE A CONSUMER IN A JURISDICTION THAT GUARANTEES STATUTORY WARRANTIES OR REMEDIES, NOTHING IN THESE TERMS LIMITS THOSE RIGHTS.

ASSUMPTION OF RISK AND RELEASE: YOU ACKNOWLEDGE THAT HUNTING AND OTHER OUTDOOR ACTIVITIES INVOLVE KNOWN AND UNANTICIPATED RISKS THAT COULD RESULT IN PROPERTY DAMAGE, BODILY INJURY, OR DEATH. YOU ASSUME ALL SUCH RISKS. YOU FURTHER ASSUME ANY RISKS OF MALWARE, FILE CORRUPTION, OR OTHER DAMAGES RESULTING FROM THE USE OF THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, AND HOLD HARMLESS TROPHY SCAN AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, MANAGERS, MEMBERS, AND AGENTS FROM ANY CLAIMS FOR PROPERTY DAMAGE, BODILY INJURY, WRONGFUL DEATH, OR LOSS OF SERVICES ARISING FROM YOUR OUTDOOR ACTIVITIES, PARTICIPATION IN THE SERVICES, THIRD PARTY ACTS RELATING TO THE SERVICES, OR YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EXCEPT TO THE EXTENT CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. TROPHY SCAN DOES NOT WARRANT THAT THE SERVICES WILL OPERATE ERROR-FREE OR THAT THE SERVICES ARE FREE OF COMPUTER VIRUSES AND OTHER HARMFUL MALWARE. IF YOUR USE OF THE SERVICES RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, TROPHY SCAN SHALL NOT BE RESPONSIBLE FOR THOSE ECONOMIC COSTS. YOU ASSUME ALL RISKS AND ALL COSTS ASSOCIATED WITH YOUR USE OF THE SERVICES, INCLUDING, WITHOUT LIMITATION, ANY INTERNET ACCESS FEES, BACK-UP EXPENSES, COSTS INCURRED FOR THE USE OF YOUR DEVICE AND PERIPHERALS, AND ANY DAMAGE TO ANY EQUIPMENT, SOFTWARE, INFORMATION OR DATA. INFORMATION AVAILABLE THROUGH THE APP OR WEBSITE COULD INCLUDE TECHNICAL OR OTHER MISTAKES, INACCURACIES, OR TYPOGRAPHICAL ERRORS AND TROPHY SCAN MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE ACCURACY OF THE SAME.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TROPHY SCAN AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, MANAGERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PRIZES, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. THESE LIMITS APPLY REGARDLESS OF LEGAL THEORY, EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER YOUR LOCAL LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless Trophy Scan and its affiliates, owners, officers, directors, employees, managers, members, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your violation of these Terms or applicable law (including game laws), and/or your actions taken using the Services.

11. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access, with or without notice, for violation of these Terms, suspected fraud or unlawful activity, or risk to the platform or other users. We may also terminate your access, with or without notice, if we decide to cease offering the Trophy Scan App, Website, or any other part of the Services. On termination, your license ends. Sections 4.1, 5, 7 through 13, and 16 survive termination. If your use of the Services is terminated for any reason, then: (a) these Terms will continue to apply and be binding upon you in respect of your prior use of the Services (and any unauthorized further use of the Services), including your indemnification obligations; and (b) any rights or licenses granted to us under these Terms will survive such termination unless otherwise stated in these Terms.

12. Dispute Resolution: Arbitration and Class Action Waiver

PLEASE READ CAREFULLY. THIS AFFECTS YOUR RIGHTS.

Informal resolution. Before filing a claim, you agree to first try to negotiate any dispute in good faith by contacting us at support@trophyscan.com and allowing 30 days for informal resolution of the dispute.
Binding arbitration. If resolution is not reached through internal negotiation, any disputes arising out of these Terms, our Privacy Policy, or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) or JAMS, rather than in court. Notwithstanding the foregoing, any disputes relating to your breach of these Terms or our Privacy Policy and/or any disputes relating to infringement of any of Trophy Scan’s intellectual property may be brought before a court of competent jurisdiction by us in accordance with Section 13.
Class action waiver. Disputes must be brought individually. YOU AND TROPHY SCAN WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Arbitration costs. If we prevail in any claim or counterclaim against you, we may be awarded reasonable attorneys’ fees and costs for arbitration or litigation, as the case may be.
Opt-out. You may opt out of arbitration by email to support@trophyscan.com within 30 days of first accepting these Terms, stating your name, account email, and intent to opt out.
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS, THE PRIVACY POLICY, OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

13. Governing Law and Venue

Texas law governs these Terms, without regard to conflict-of-law rules. For disputes not subject to arbitration, exclusive venue is in the federal court of the Western District of Texas or the state courts in Llano County, Texas, and you consent to their jurisdiction. Nothing in this Section deprives you of the mandatory consumer protections of the state or country in which you reside, and if you are a consumer in the EU or UK, you may bring proceedings in the courts of your home country and rely on the mandatory provisions of its law.

14. Communications

Service and account messages. We may send transactional and service communications, such as account confirmations, security alerts, purchase receipts, scan-processing notices, trophy-transfer notices and invitations, and notices of changes to these Terms in order to provide the Services. These messages are not considered marketing materials or to solicit business and are not subject to marketing preferences. These messages may be sent periodically for as long as you maintain an account with us.
Marketing communications. We may send marketing emails in accordance with your preferences, which you may change at any time in the App (Notifications settings, under Marketing emails) or through the unsubscribe link in any marketing email.
Text messages. We do not currently send marketing text messages. If we offer marketing by SMS, it will require your separate, express opt-in. It is not a condition of using the Services, and providing a telephone number for sign-in or account security is not an opt-in to marketing text messages. Reply STOP to any marketing text message to opt out.

15. Changes to These Terms

We may update these Terms. For material changes, we will give notice in the App, by email, and/or on the Website at least 14 days before they take effect, except for changes required by law, which may take effect immediately. Continued use of the Services after the effective date constitutes acceptance of the changes. The "Last Updated" date identifies the current version of the Terms.

16. Miscellaneous

These Terms and the Privacy Policy constitute the entire agreement between you and Trophy Scan. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of that provision. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets. We may give notices in the App or by email to the address on file.
